Welcome to Elite Motion 360 NI (“we,” “us,” or “our”). By accessing or using our 360° video booth services, website, or related products, you agree to comply with and be bound by the following Terms of Service. Please read them carefully. If you do not agree with any part of these terms, you may not use our services.
1. Services Overview
Elite Motion 360 NI provides 360° video booth rental services for events, including weddings, corporate functions, and parties. Our services include setup, operation, and delivery of video content generated during the event.
2. Booking and Payments
- Booking: To secure our services, clients must complete a booking form and provide all required information, including event details, location, and contact information.
- Deposits: A non-refundable deposit is required at the time of booking to reserve your event date. The remaining balance is due prior to the event, unless otherwise agreed upon in writing.
- Cancellations: Cancellations made more than 30 days before the event will result in the loss of the deposit. Cancellations made within 30 days of the event may incur additional fees.
- Rescheduling: Clients may request to reschedule their event based on availability. A new booking confirmation will be provided upon approval.
3. Use of 360° Video Booth
- Event Setup: We will arrive in advance to set up the booth, ensuring it is fully operational before your event begins. Any delays caused by venue restrictions may affect service delivery.
- Booth Operation: A trained attendant will be present during the event to assist guests and ensure the booth operates smoothly.
- Event Conduct: The client is responsible for ensuring that guests behave respectfully while using the booth. We reserve the right to shut down the booth temporarily or permanently if guests or circumstances pose a risk to equipment or safety.
- Technical Issues: While we strive to provide seamless service, technical issues may arise. In such cases, we will work to resolve the issue as quickly as possible. If the booth becomes inoperable for an extended period, we may offer a partial refund or service credit.
4. Content and Ownership
- Video Content: Videos and images captured during the event belong to Elite Motion 360 NI. However, we grant the client and event participants a license to use and share the videos for personal, non-commercial purposes.
- Usage Rights: By using our services, you grant us permission to use event photos and videos for promotional purposes, including on our website and social media, unless otherwise agreed upon in writing.
- Guest Consent: It is the client’s responsibility to inform guests that their images and videos may be captured and shared. By participating in the event, guests agree to these terms.
5. Client Responsibilities
- Event Access: The client must provide access to the event space and ensure adequate time for booth setup and takedown.
- Space Requirements: The 360° video booth requires a minimum of 10×10 feet of space and a stable surface for setup. The client must inform us of any space limitations in advance.
- Electrical Access: The client is responsible for providing access to electrical outlets required for booth operation.
6. Liability and Indemnification
- Damage to Equipment: The client is responsible for any damage to our equipment caused by guests, event attendees, or venue staff. Repair or replacement costs will be billed to the client.
- Liability Limitation: Elite Motion 360 NI will not be held liable for any injury, loss, or damage caused by the use of our services, including but not limited to, technical failures or force majeure events.
- Indemnification: The client agrees to indemnify and hold Elite Motion 360 NI harmless from any claims, damages, or losses arising from the use of our services during the event.
7. Force Majeure
We will not be liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to, natural disasters, strikes, or other unforeseen events that make performance impracticable.
8. Termination
We reserve the right to terminate or refuse service at any event if these Terms of Service are violated, or if any conditions arise that endanger our staff, equipment, or guests. In such cases, no refunds will be issued.
9. Changes to Terms
Elite Motion 360 NI reserves the right to modify these Terms of Service at any time. Any updates will be posted on our website, and continued use of our services after changes have been made constitutes acceptance of the updated terms.
10. Governing Law
These Terms of Service are governed by the laws of Northern Ireland, and any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts in Northern Ireland.
